Both women who have now sued work in healthcare themselves

CHALMETTE, LA / ACCESS Newswire / August 19, 2026 / A second patient has filed suit against Dr. David Allen Beary, St. Bernard Parish Hospital, and Ochsner Health, alleging she is one of several sedated patients the gastroenterologist assaulted during procedures at the Chalmette hospital this spring. Like the plaintiff in the first suit, she is a healthcare professional herself.

The new petition, filed August 17, 2026, in the 34th Judicial District Court for the Parish of St. Bernard, was brought on behalf of a 48-year-old woman identified in court records by her initials, G.U. It is the second case filed against Dr. Beary and the hospital arising from the same set of allegations, and names the same defendants: Dr. Beary, the Hospital Service District of the Parish of St. Bernard d/b/a St. Bernard Parish Hospital, and Ochsner Clinic Foundation d/b/a Ochsner Health, which manages the facility.

G.U., like the first victim, V.H., is represented by Rachel M. Naquin of JJC Law LLC, Blake Corley of Daly and Black, and former Judge Arthur Hunter.

According to the petition, G.U. underwent a colonoscopy at St. Bernard Parish Hospital on or about May 1, 2026. While she was sedated and unable to consent or resist, Dr. Beary allegedly grabbed her breasts with no legitimate medical purpose. A surgical technician in the room told hospital supervisors the same day that she had seen Dr. Beary do this to multiple sedated patients during a string of procedures, a report that triggered a hospital referral to the Louisiana Department of Health and a St. Bernard Parish Sheriff's Office criminal investigation that led to Dr. Beary's arrest on four counts of sexual battery.

What the petition emphasizes is the gap that followed. Although the hospital had a firsthand report the day of the incident, G.U. says she wasn't told she had been victimized until on or about June 4, 2026, 34 days later.

"A hospital that knows a patient was assaulted has one job in that moment, tell her," said Blake Corley. "Instead our client spent over a month not knowing what had happened to her own body, unable to get care or make decisions with the facts she deserved to have."

Rachel Naquin said the second filing underscores that this was not an isolated incident. "One report to hospital staff described a pattern, not a single incident. Our clients filed these lawsuits to make sure this never happens to another woman again."

The lawsuit brings claims of sexual battery against Dr. Beary and negligence claims against the Hospital District and Ochsner for their credentialing, supervision, and notification practices. It seeks damages for emotional distress, psychological care, and loss of enjoyment of life, and requests a jury trial.
