With this announcement, Butler Kahn details the tragic death of Rosie Minor - an ordained minister and Bible study leader who was struck and killed while turning left from Memorial Drive onto Hearthstone Drive. Ms. Minor seemingly had enough time to turn safely, but another driver, Nikia Cherry, who was going 28 MPH over the speed limit, crashed into Ms. Minor in a fatal t-bone accident.

In a recently published case study review, the law firm also details the evidence they obtained that found the offending driver to be negligent. These include eyewitness reports of the speeder swerving around another vehicle and phone records indicating she was using her cell phone while driving. Butler Kahn further bolstered its defense by acquiring security footage from a nearby house and working with computer graphics experts to recreate the crash.
Despite the significant evidence against the other driver, the initial police report blamed Ms. Minor for her fatal wreck. Ms. Cherry’s insurance company also rejected the firm’s demand for an insurance payout of the full insurance limits.
With the insurer refusing to settle the case, Butler Kahn decided to fight a lengthy legal battle to obtain financial compensation for Ms. Minor’s loved ones. The insurance company retained defense attorneys, who hired their own accident reconstructionist and argued that Ms. Minor had caused her death by failing to yield the right of way.
The case eventually went to trial, during which the firm’s attorneys argued the facts while the Minor family testified to the late woman’s character. Just seconds before the verdict was due, the insurance company accepted a counter-settlement offer from Butler Kahn for $10 million.
During the trial, one of Ms. Minor’s daughters met with Ms. Cherry and forgave her. After the settlement, Ms. Cherry and her family were welcomed as members of the church that Ms. Minor had dedicated much of her life to.
