This recently published legal guidance is important because of the framework established by the Alberta Estate Administration Act (AEAA). This legislation came into effect on June 1, 2015, and it governs all tasks related to estate administration. Although efforts were made to draft the act in plain language to help personal representatives understand their duties, notice requirements, and responsibilities, many people still struggle through the process of executing a will. JK Law explains that since the majority of people will only interact with this legislation once or twice in their lives, and often during a grieving process, a large number are often unsure that they are correctly following the AEAA's requirements.
The Act outlines four core tasks for a personal representative. These duties include identifying the estate's assets and liabilities, administering and managing the estate, and paying all debts. The final task is to distribute the remaining assets to beneficiaries and provide a full accounting of the administration.
JK Law's new publication translates these legal duties into a practical, step-by-step plan for estate management. It outlines important initial actions, such as locating the deceased's original will, which may be with an attorney or in a safety deposit box. The guide also details the completion of government paperwork, like the Registration of Death form, and inventorying all estate assets with professional valuations where required.
A key section of the guide addresses when probate is necessary. Probate is the court's official validation of a will, confirming the executor's authority to act for the estate. While not every estate requires probate, it is often a required step and can complicate the process outlined in the AEAA. JK Law states that most financial institutions will demand a Grant of Probate before releasing significant funds from a deceased's accounts, so familiarity with the process is an asset.
JK Law's resource also details the concluding steps for legal and financial closure. This includes filing the deceased's final income tax returns and obtaining a Clearance Certificate from the Canada Revenue Agency to avoid personal tax liability. Once all liabilities are settled, the publication explains how to distribute remaining assets as specified in the will and obtain signed receipts from all beneficiaries. Thus will executors can follow instructions to guide them through every step from being informed of the death to concluding the estate's business.
JK Law is a Calgary-based probate and estate law firm with over three decades of combined experience. The firm's lawyers assist personal representatives in fulfilling their duties. JK Law provides legal guidance to help manage the estate efficiently and respect the deceased's final wishes throughout the process.
