Austin, TX - The decision to file for divorce stirs up financial and emotional issues that lead to legal disputes and conflict. One of the most challenging aspects of a divorce involves child custody negotiations. Deciding who a child should live with, how much time the other parent should spend with them, and other related issues is stressful to the child, parents, and family.
Smith & Bledsoe Family Law can help divorcing spouses put their feelings aside and arrange a custody agreement that meets their interests and ensures the child/children’s well-being. The Austin family law attorney has over 15 years of combined legal experience representing Texas clients in various divorce, child custody/support, alimony, and property division matters.
Texas recognizes managing conservatorship, which gives a parent the right to make essential decisions about their child’s life, and possessory conservatorship, which stipulates where the child will live at any given time and when each parent has time with their child. Texas Family Code 153.131 requires the court to appoint one or both parents as joint managing conservators unless it wouldn’t be in the child’s best interest.
While the law allows flexibility in custody negotiation so that both parents can decide on the terms, a judge can intervene and use a standard possession order or visitation order if the parties cannot agree on a conservatorship agreement.
A sole managing conservator under state law can give/receive a receipt for periodic child support payments and disburse/hold funds to benefit the child, designate the child’s primary residence, consent to enlistment in the US armed forces/marriage, make decisions about the child’s education, consent to medical treatments, act as the child’s agent in an estate, and represent the child in legal action.
The Texas Family Code 153.001 ensures that a child has frequent and continuing contact with parents, the parents share in the duties/rights of raising their child after separation/divorce, and the parents provide a stable environment for the child. Although the child can voice their preference of who they would rather live with, their wishes aren’t legally binding in court.
When the stakes are high, Smith & Bledsoe Family Law leverages extensive resources and family law statutes to help clients navigate every step of the custody process. The firm protects children’s and their parents’ interests by creating comprehensive agreements, modifying orders, filing restraining/protective orders, and breaking down child support guidelines.
With a passionate reputation for fighting for families, the family law attorney has a command of the law, knowledge of sitting judges in Travis and surrounding counties, and a powerhouse litigation style.
