On November 4, 2008, First Data Corporation (the "Company") and InComm Holdings Inc. ("InComm") announced that they have mutually agreed to terminate the planned acquisition of InComm. A copy of the press release issued by the Company and InComm relating to the announcement is included as Exhibit 99.1 to this report.
