Item 5. Other Events and Regulation FD Disclosure.
On July 12, 2004, Ampex Corporation announced that it has filed a complaint with the International Trade Commission seeking an exclusion order barring Sony Corporation from the importation and sale of digital still cameras and personal digital assistants (PDAs) with digital image storage and retrieval capabilities into the United States due to Sony’s unauthorized use of Ampex’s intellectual property. Ampex also announced that it has filed suit in the U.S. District Court for the District of Delaware, seeking unspecified damages from Sony for patent infringement. A copy of Ampex’s press release is included as Exhibit 99.1 to this report and is incorporated herein by reference.
